Abstract

The Portuguese Government, the European Commission, the European Central Bank and the International Monetary Fund signed a Memorandum of Understanding on Specific Economic Policy Conditionality on May 17th 2011, in the context of Portugal’s request for financial aid. This agreement includes the Portuguese Government’s engagement to develop a legislative reform aimed at introducing adjustments to the cases for fair individual dismissals, namely the possibility of dismissal for unsuitability of the worker even without the introduction of new technologies or other changes to the workplace.

Regarding specifically the referred amendment, this paper analysis Portugal’s current dismissal legislation, the merits of the alteration and its constitutional compatibility.
